ATTORNEY MORRIS LOWENTHAL of San Francisco handled the appeal which resulted in the California Appeals Court decision reprinted on pages 11-21 of this issue of the REVIEW. Mr. Lowenthal has handled another now-famous case in this field when he successfully carried an appeal in the case of STOUMEN V. REILLY. to the California Supreme Court (37 Cal., 2d 713) as amici ouriae on behalf of appellants several years ago. In each instance, the courts have held that free movement and association of persons not engaged in unlawful acts cannot be denied by law--that is, in these specific instances, they cannot be denied the right to patronize a bar or restaurant on the basis of being homosexual, nor can an establishment's license be revoked for this cause. Both the attorney and the appellants deserve special commendation for the great expense and effort such legal battles involve, not for the benefits of homosexuals alone, but on behalf of all minority groups whose rights are often whittled away by over-zealous legislators acting on emotions or on the pressure of some disapproval.
